EPF Pension cases hearing completed in Apex court judgement reserved

New Delhi: The Hon’ble Supreme Court on 11-8-22 has concluded the final hearing in the long awaited EPS’95 matter involving lakhs of pensioners. In August,2022 the two judges bench comprising Justice UU Lalit after hearing EPFO’s senior counsel referred the matter to a three judges bench. The pensions’ didn’t get a chance to oppose the reference to three judges bench. There are around 67 cases filed by various associations of retired employees.

The prominent Writ Petition No. 1134 of 2018, involving around 60,000 pensioners of private and public sectors retirees and working employees, is titled VN Sharma (Member of National Confederation of Retirees) & Others Vs EPFO was filed jointly by National Confederation of Retirees and National Confederation of Officers’ Association (of working officers of PSUs). The main issues in writ petition were(1) the applicability of the R C Gupta Judgement allowing enhanced pension on actual salary a(2) the 2014 amendment done by EPFO fixing a cap of salary of Rs.15,000/- for calculating EPS pension and debarring other employees from the purview of EPS pension and (3) the EPFO Circular of May 2017 debarring pensioners of those organisations

whose Provident Fund was kept in departmental PF Trust.

After completing the hearing the Hon’ble Supreme Court has reserved it’s judgement. Now all eyes are on the result of the case and old aged pensioners are eagerly awaiting for the judgment.
